Driving under the Influence of Intoxicating Substances
In Washington driving or being in actual physical control of a motor vehicle while under the influence of intoxicating liquor or drugs (methamphetamine, heroin, cocaine, marijuana, etc.) is illegal. Additionally, there is a crime of Negligent Driving first degree which makes it illegal to drive negligently and exhibit the effects of having consumed alcohol or drugs.
Drug DUI
A DUI for drug intoxication requires a blood test or DRE (Drug Recognition Expert Evaluation). However, there are no penalties enumerated for refusing a drug test in Washington, as there are for refusal to submit to the breathalyzer test.
