Underage DUI

Underage DUI is essentially the same as a regular DUI (see Driving Under the Influence) except the driver is under the age of 21 and could find themselves charged additionally with Underage Drinking. In an Underage Drinking charge, the City or State needs to prove that the person is under 21 years of age and had alcohol in their body at the time of arrest.  This is also known as "Not a Drop Violation" which is a misdemeanor offense punishable by up to 90 days in the county jail and a $750 fine.
