Driving with a Measurable Amount of a Controlled Substance in the Body
In Utah, a person can be convicted of this offense if they are driving a motor vehicle and have in their body any amount of a controlled substance. It is not necessary for you to be actually impaired or be driving recklessly to be convicted of this offense. To prove the case the prosecution will only need to prove that you were driving a vehicle and that your blood or urine contained either a controlled substance or evidence that the substance had recently been in your body. If, while driving, you are involved in an accident which results in the death of another, the offense will be considered "Automobile Homicide."
