Idaho Driving With Controlled Substances

In Idaho, a person can be convicted of this offense if they are driving a motor vehicle and have in their body any amount of a controlled substance. A DUI for drug intoxication requires a blood test or DRE (Drug Recognition Expert Evaluation). However, Idaho law does not require you to submit to a blood test or DRE. If however, you take a breathalyzer and fail or refuse the breathalyzer, you may be subjected to a blood draw against your will.
